Customer Order Terms and Conditions
Congratulations on having placed an order for an heirloom quality piece of furniture! Prior to placing the order, you must accept the following terms and conditions.
1. Products. The Products we import are unique, hand-crafted, custom designed pieces of extremely high quality in both materials and workmanship. Because individual craftsmen construct each individual piece of beautiful exotic natural wood and other materials by hand, no two pieces will be exactly the same. Each piece will display unique variances in both finish and detail. This is part of the beauty and uniqueness of the Products you are buying.
2. Placing Orders. Once an order is received by telephone or website we will generate an Order Confirmation Agreement between Casa di Sorrento, Inc and the customer. We will e-mail a copy of the Confirmation along with the Customer Order Terms & Conditions. You must read and reply to by e-mail and confirm that you agree with the documents. Please check the order carefully for accuracy. Orders cannot be processed without an e-mail reply to the Customer Order Confirmation and Terms & Conditions.
3. Returns. Your custom piece is made specifically for you and, therefore, your order is final and cannot be cancelled or changed once it is placed.
4. Prices. The prices quoted to you are in U.S. dollars. The price quoted to you at the time of sale and payment will not change; however, Casa di Sorrento, Inc reserves the right to change pricing from those published on the website to adjust for many factor to include, but not limited to, significant fluctuations in currency conversions between the dollar and euro, changes in costs of exotic woods, and transportation costs. We use the Federal Reserve as the source for calculating currency conversions at times of dramatic changes in international currency rates.
5. Payment Terms. You are required to pay in full at the time that the order is placed with Casa di Sorrento, Inc. Personnel check, bank check, money order, credit card, wire transfers or cash are accepted as methods of payment. All checks must clear the bank before the order is released.
6. Shipping. The furniture pieces you are buying are shipped from the manufacturer’s location in Italy directly to your home or location of your choice. The price you have been quoted includes all shipping, insurance, Italian export duties, and other expenses from Italy to the delivery address you have indicated. There will be an additional expense incurred by the customer (4% of sales price for furniture purchases) for payment of U.S. tariff/customs duties. These are duties imposed by the United States Government on imported products. Casa di Sorrento, Inc will coordinate the delivery, making it easy to order and receive your furniture. Expected lead-time on delivery for pieces in stock is approximately three weeks. Special orders may take several months depending on the requirements and specifications levied by the customer. Each piece is shipped via ground and/or air and sea transportation to your doorstep. Purchaser will be required to bring the shipment into the delivery location, and unpack/inspect the order. Damage incurred during shipping is extremely rare, however if damage is incurred, the purchaser must notify Casa di Sorrento, Inc within five days of receipt. Any damage incurred as a result of shipping will be repaired an/or replaced at no charge to the purchaser by the manufacturer. In those cases where the customer contracts with a third party to receive, deliver and place the items in their desired delivery location, Casa di Sorrento, Inc is not responsible for costs or damages which may be incurred once the third party accepts delivery.
7. Delays in Shipment or Delivery. There are many circumstances beyond our control that may adversely impact the shipment or delivery schedule. These include, but are not limited to: factory production backlogs, vacation schedules, materials shortages, strikes affecting airlines, trucks or other modes of transportation, transportation delays (trucks and/or airline or ship delays or strikes), U.S. Customs and Homeland Security delays, accidents, mechanical problems and other unexpected events. Although we don’t foresee that any of these things will occur, there is always the possibility that something of this nature may happen. In such an event, we ask that you have patience and we will do everything that is reasonable and within our control to help the situation.
8. Damages. Shipments are fully insured. In the rare event that the contents are damaged in transit, a claim must be placed with the manufacturer through Casa di Sorrento Inc, within five days. The manufacturer reserves the right to restore or replace the piece at their expense. It is your responsibility to inspect the Products when they are delivered to ensure that there has been no damage in transit. If there is damage, you must document and photograph it along with immediately notifying Casa di Sorrento Inc. If there is severe damage, you should refuse to accept delivery. We will assist you any way we can in placing your claim with the shipper and manufacturer.
9. Warrantees. The manufacturer we deal with is a highly respected, high quality, reputable establishment that has been in business since 1863. They warrantee their furniture for quality materials and workmanship. If a product or any of its components are defective, other than for slight variances as explained in section 1 above, we will make sure it is replaced or restored by the manufacturer or by a local company qualified to do the work.
10. Notices. Any notice that is required to be given by one party to the other party by the terms of this Agreement shall be in writing and sent by the equivalent first-class mail prepaid, by fax or by e-mail.
11. Entire Agreement. This Agreement contains all understandings and agreements between the parties and may not be modified or supplemented except in a writing signed by both parties.
12. Governing Law. The laws of the Commonwealth of Massachusetts, U.S.A., without regard to conflicts of law principles, will govern this Agreement. Any and all legal claims must be filed within the Commonwealth of Massachusetts.
